RE: The tariff classification of a carded wool yarn for commercial sweater knitting or fabric weaving, from Taiwan.

Dear Mr. Guo

In your letter dated September 25, 1997, you requested a tariff classification ruling.

The instant sample, identified as Wool Velveteen, (style C075), consists of a wool twist yarn composed of a 75% wool/25% rayon man-made fiber blend. Your letter indicates that this yarn has a 1/4 nm count and uses 22/23 micron wool. We note per a recent telephone conversation with your office that this is a carded as opposed to a combed wool.

The applicable subheading for the yarn will be 5106.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for yarn of carded wool, not put up for retail sale, containing less than 85 percent by weight of wool. The rate of duty will be 8.1 percent ad valorem.

This merchandise falls within textile category designation 400. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
